2. About Nutrinixy

Nutrinixy is a nutrition and wellness application designed to help users track meals, calories, macronutrients, hydration, weight, and related health and wellness information.

Nutrinixy may include features such as food logging, barcode scanning, photo-based meal recognition, voice-based meal logging, AI-generated nutrition insights, reports, and related tools.

Some features may be available free of charge, while others may require a paid subscription.

If you are under the age of 18, you may use Nutrinixy only with the consent and supervision of a parent or legal guardian, to the extent required by applicable law.

Any calorie estimates, nutrient calculations, AI-generated answers, meal analysis, reports, wellness suggestions, or other outputs are provided for informational purposes only and may be incomplete, estimated, or inaccurate.

You should consult a qualified physician or other licensed healthcare professional before making significant changes to your diet, weight, exercise, supplements, or lifestyle, especially if you are pregnant, nursing, under medical supervision, have a medical condition, or take medication.

You use Nutrinixy at your own risk and remain solely responsible for your health decisions and actions.

5. Accounts

Some features of Nutrinixy may require you to create an account.

You agree to provide accurate, current, and complete information and to keep your information up to date.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account, except where caused by our fault.

7. Paid subscriptions

Paid subscriptions are offered only through third-party distribution platforms, including the Apple App Store and Google Play, unless we explicitly state otherwise inside the product.

If you purchase a subscription through Apple App Store or Google Play, billing, payment processing, renewals, cancellations, refunds, and related purchase matters are handled under the terms and policies of the relevant platform.

Subscription prices, billing cycles, included features, and trial terms, if any, will be shown before you complete your purchase.

Unless otherwise stated, subscriptions may renew automatically until canceled through your Apple App Store or Google Play account settings.

You are responsible for managing and canceling your subscriptions through the platform from which you purchased them.

We may change available subscription plans, pricing, or premium features from time to time, subject to applicable platform rules and law.

8. Free features and service changes

Certain parts of Nutrinixy may be provided free of charge.

We may modify, update, suspend, limit, or discontinue any part of the Services, including free features, at any time for legal, business, operational, technical, or security reasons.

We do not guarantee that any feature or functionality will remain available permanently.

These sources may include, where applicable, Open Food Facts, OpenNutrition, and other third-party or open-licensed data providers used by Nutrinixy under their respective terms, licenses, or permissions.

Such third-party content and data may be subject to separate license terms, attribution requirements, and usage conditions imposed by the relevant source.

Where required, Nutrinixy provides attribution inside the app or related legal materials.

We do not guarantee the accuracy, completeness, availability, legality, or fitness of third-party data and content, and you acknowledge that food, barcode, ingredient, and nutrition data may contain errors, omissions, mismatches, or outdated information.

10. Intellectual property

The Nutrinixy website, app, software, design, branding, interfaces, text, graphics, and original content provided by us are owned by or licensed to IE EVGENII ALEKSANOV and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use Nutrinixy for your personal, non-commercial use.

You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, lease, sublicense, or otherwise exploit any part of Nutrinixy except as expressly permitted by these Terms or by applicable law.

If you provide feedback, ideas, or suggestions about Nutrinixy, you grant us the right to use them without restriction or compensation.

11. Availability and warranty disclaimer

We do not guarantee that calorie counts, macro calculations, AI outputs, reports, barcode matches, photo recognition results, voice recognition results, or nutrition data will be fully accurate, complete, or suitable for your specific goals.

Nothing in these Terms excludes any non-waivable rights you may have under applicable consumer protection law.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, loss of data, loss of goodwill, or business interruption arising out of or related to your use of Nutrinixy.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, willful misconduct, or any liability that cannot be excluded under applicable law.

To the extent liability may legally be limited, our total liability for claims arising out of or related to Nutrinixy will not exceed the amount you paid, if any, for the Services during the 12 months preceding the event giving rise to the claim.

13. Termination

You may stop using Nutrinixy at any time.

You may request deletion of your account by using available in-app settings or by contacting [email protected].

We may suspend or terminate your access to Nutrinixy immediately if you materially breach these Terms, misuse the Services, create legal or security risk, or if termination is required for legal or operational reasons.

Upon termination, your right to use the Services ends immediately, but provisions that by their nature should survive termination will remain in effect.
